1. Service Description

Seedream 5 provides an AI-powered image generation platform that allows users to:

Generate images from text descriptions
Edit and transform existing images
Access various AI models and creative tools
Download and use generated images

2. User Accounts and Registration

To access certain features of the service, you must create an account. You must:

All prices are in USD unless otherwise stated

3.2 Billing

Subscriptions are billed monthly or annually based on your selected plan
Payments are processed through Stripe, our secure payment processor
You authorize us to charge your payment method for all fees incurred
Prices may change with 30 days' notice to existing subscribers

3.3 Refunds

Refunds are governed by our Refund Policy
We offer a 7-day money-back guarantee for first-time subscribers
Unused credits are non-refundable except as stated in our Refund Policy

3.4 Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of your current billing period
You retain access to paid features until the end of the billing period

4. Credits and Usage

4.1 Generation Credits

Each plan includes a monthly allocation of generation credits
Credits are consumed based on image resolution and AI model used
Unused credits may roll over for annual plans (see plan details)
Credits expire upon subscription cancellation (30-day grace period)

4.2 Fair Use Policy

We reserve the right to limit usage that we determine to be excessive or abusive, including:

Automated or bot-driven generation
Reselling of generation services
Activities that degrade service performance for other users

5. Content and Intellectual Property

5.1 Your Generated Content

You retain ownership of images you generate using Seedream 5
You receive a commercial license to use generated images
You are responsible for ensuring your use complies with applicable laws
You may not claim that AI-generated images were created entirely by you without AI assistance

5.2 Our Intellectual Property

Seedream 5 platform, technology, and branding are owned by seedream-5.art
You may not copy, modify, or reverse engineer our service
You may not remove or alter any proprietary notices

5.3 Input Content

You retain ownership of any images or text you upload
You grant us a license to process your input for service delivery
You represent that you have rights to any content you upload

6. Prohibited Uses

You agree NOT to use Seedream 5 to:

6.1 Illegal Content

Generate illegal content or content that violates laws
Create content depicting illegal activities
Violate intellectual property rights of others

6.2 Harmful Content

Generate content that is defamatory, harassing, or threatening
Create deepfakes or misleading content of real people without consent
Produce content that promotes violence, hatred, or discrimination

6.3 Inappropriate Content

Generate sexually explicit content involving minors (strictly prohibited)
Create content that violates our content policy
Produce spam or misleading content

6.4 Service Abuse

Attempt to circumvent usage limits or security measures
Use automated systems to access the service without authorization
Interfere with or disrupt the service
Resell or redistribute our service without authorization

7. Content Moderation

We employ automated and manual content moderation
We reserve the right to remove content that violates these Terms
Repeated violations may result in account suspension or termination
We are not responsible for user-generated content

8. Service Availability

8.1 Uptime

We strive for high availability but do not guarantee uninterrupted service
Scheduled maintenance will be announced when possible
We are not liable for service interruptions

AI-generated images may not always meet your expectations
We do not guarantee the accuracy, quality, or suitability of generated content
You are responsible for reviewing and approving generated content before use

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEDREAM 5 AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Seedream 5, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any rights of another party
Content you generate or upload
